I think that
Elena Sassower's indictment and incarceration is a miscarriage of
justice because the videotape of the session indicates her comment
was made after the Chair announced the session was dismissed. Moreover,
I think her imprisonment is unconstitutionally disproportionate
to such inconsequentially "disruptive" "offense" and obviously Ms.
Sassower did not commit this "offense" for personal gain or bad
intent, but rather clearly out of deeply held personal conviction
that the mechanisms of government need citizen oversight. Moreover,
clearly she has suffered unfairly discriminatory treatment compared
to others, for example, the denial of a stay pending an appeal and
denial of a reasonable amount of time to prepare her affairs between
sentencing and imprisonment so that she would not unfairly suffer
serious collateral consequences in other aspects of her life, so
contrary to the considerations showed in these regards to others
like John Gotti, Martha Stewart, etc. This is beneath our justice
system. |

Constructive
non violent criticism is one of the fundemental rights and duties
of americans and should be encouraged even by those who express
unpopular views as it helps all of us come to a better understanding
of the issues and the effects and emotions revolving around those
issues. Certainly we should not be dispensing unduly harsh sentences
for minor infractions of rules especially where such rules are not
generally known about and apparently meant to deal with much more
severe offenses. Please remember that the government of the people,
by the people, and for the people needs to be always respectful
and tolerant of the people by whose delegated authority they serve.

is a prisoner of conscience, by definition. But where is Amnesty
International? Where is the ACLU? We should all be grateful, to
the fullest extent, for Elena's sacrifice; a sacrifice not just
for those that are appearing in court in recent days, but for Americans
who might also have to face unjust judges of our judiciary. Elena
was a hero before she was wrongfully imprisoned; now she's a martyr
for standing up to corruption. Whence Elena is release from prison,
I hope she has the strength, support, and resolve to continue the
phenomenal work she has done over the past 15 years or so. Please
free Elena Ruth Sassower, now. Thank you. |

As a practicing
attorney, I am all too familiar with pro se litigants being treated
like second class citizens in the court room. However, in my 20
years of practicing law, this is the vilest case of unlawful mistreatment
of any pro se litigant I have ever heard of, witnessed, or could
have even imagined. And though this story has had some great coverage
(New York Law Journal, Philadelphia Inquirer, and on various Internet
sites), I can't help but wonder why the other major media won't
run the story. They are giants. Elena is but one person. How could
she have the bravery to stand up, only to have the New York Times
shut her heroism down? How can the Washington Post write a story
defaming her? This is not the judiciary our forefathers had intended
to exist; rather, quite the opposite. For the good of the country,
please free Elena, as she should have never - not for one second
- been placed behind bars. |

tear down the wall that seperates us from our rights under the constitution.

Sassower was forced to stand a trial without any probable cause.
She was tried in a sham trial conducted under a squelching machine
with a presiding judge who saw fit to manipulate the outcome of
a "jury trial." (read more: www.secretjustice.org). To add more
insult to our system of "law and justice," Judge Brian F. Holeman
rendered a sentence amounting to a McCarthy-era-witch-hunt and the
silencing of the voice of truth-seeking citizens. Judge Holeman
finished his "job" by denying a stay pending appeal in a hope that
this will moot any appellate review and his freewheeling will miraculously
disappear . Not to mention the fact that there are at least two
different court-made transcripts from a single sentencing proceeding
... How is this possible? Is Judge Holeman above the law? Judge
Holeman should not allowed to remain on the bench and play fast
and loose with the lives, rights and freedoms of our citizens,
let alone with the U.S. Constitution. |
